Road Accident: Adopt the Right Reflexes!

What better way to unwind than a vacation? Imagine taking off one morning, heading to… let’s say Spain. Unfortunately, not every trip goes as planned…

The accident report: an often-neglected valuable ally

You’re driving calmly when suddenly, a poorly driven truck hits the rear of your car. A seemingly simple accident. No need to panic! You think you know how to fill out an accident report correctly… or maybe not?

No date, no location, and you noted down a license plate number: the truck’s trailer one. Hmm… You check box number 8 “Hit the rear while driving in the same direction, in the same lane.” You draw a rough sketch without identifying the vehicles and omit some observations.

The result: this situation turns against you, and you don’t receive any compensation. How can you avoid this scenario?

Here are some tips to be well-prepared in case of a road accident:

  1. Always note the date and location, at least the country!
  2. Mention any injuries, even the minor ones.
  3. If witnesses are present, note all their contact details: ghosts can’t help you.
  4. If an item like a smartphone or coat is damaged, check the appropriate box.
  5. Note the other vehicle’s license plate or, even better, take a photo!
  6.  In case of a truck, note the front plate, as the trailer plate does not guarantee compensation.
  7. Indicate the point of impact and specify the type of damage.
  8. Check the box that best fits the situation (the nuance between “hit” and “was hitting” is crucial).
  9. Even if you’re not an artist, try to respect the proportions and positions of the vehicles in the sketch.
  10. Add details: the road and signs can clarify the situation (and a photo is always precious).
  11. Take photos of the damages and vehicles before moving them.
  12. Never forget to note observations: every detail counts (like having your indicator on, for example).
  13. Finally, the most important, do not sign the report if you disagree! Or clearly state your disagreement in the observations.
  14. If everything went smoothly, ensure you get the other party’s signature: no co-signed report, no agreement on the facts.

No Accident Report: What to Do?

If the other party is uncooperative, it’s crucial to contact the police. They can help you draft the report and file a police report in case of disagreement.

In the event of a hit-and-run, don’t chase the offender. Go to the nearest police station with the gathered information. Mention every detail in your statement (vehicle model, color, license plate) and name potential witnesses. The “reasonable” period to file a complaint is 30 days.

And What About Legal Protection?

You are now better prepared in case of an accident, but are you sufficiently covered?

Fortunately, your broker can advise you to subscribe to independent legal protection insurance to best defend your interests. This coverage can be useful in the following situations:

  1. Claims against a third party insured abroad;
  2. Claims when the damages do not involve a vehicle;
  3. Requesting a deductible from a third party;
  4. Giving advice in case of a disagreement with the auto liability insurer;
  5. Legal defense in case of a citation to appear for a traffic violation;
  6. Etc.

In conclusion, although not mandatory, legal protection insurance offers extra security for anyone on the road.
